Privacy Policy

Our privacy policy and how we use your data

1. Introduction

Welcome to Photo Make! This Privacy Policy explains how Photo Make ("Photo Make", "we", "our", or "us", a service operated by BRAINFLEET LLC, Wyoming, USA) collects, uses, processes, and safeguards your personal information when you access or use photomake.ai ("Website", "Services").

2. Information We Collect

We collect only the information necessary to provide, secure, and improve our Services:

  • Account & Identity Data: Your name, email address, authentication identifiers, and profile settings when you register for an account.
  • Billing & Transaction Data: Subscription plan details, billing status, and transaction identifiers. Full payment card numbers are processed directly by our PCI-DSS compliant payment processors and are never stored on our servers.
  • User Content (Prompts & Uploaded Images): Text prompts, uploaded source photographs, and AI-generated output images that you submit or create through the Services.
  • Technical & Usage Data: IP address, browser type, device identifiers, pages visited, and interaction logs collected via cookies and analytics tools.

3. How We Process Uploaded Images and AI Prompts

When you submit a text prompt or upload an image for AI editing or detection, your input is transmitted over encrypted HTTPS connections to our AI inference infrastructure and automated safety classifiers solely to generate your requested output and enforce our Acceptable Use Policy (preventing NSFW, deepfakes, NCII, and unlawful content). We do not sell your uploaded photos or generated images to third parties, nor do we make your private gallery images publicly visible. You may permanently delete your generated images from your gallery at any time.

4. How We Use Your Information

  • Service Delivery: To authenticate your account, process AI image generation and editing requests, manage your image credits, and process subscription payments.
  • Safety & Compliance Moderation: To detect, prevent, and block prohibited content under our Acceptable Use Policy and prevent payment fraud or abuse.
  • Customer Support & Transactional Notices: To send receipts, subscription renewal notices, verification codes, and respond to support inquiries.
  • Platform Improvement: To monitor service uptime, debug technical errors, and improve application performance.

5. Sharing of Information and Service Providers

We do not sell or rent your personal data. We share data only with trusted third-party service providers strictly as needed to operate Photo Make:

  • Payment Processors: To securely process credit card and subscription payments and handle tax compliance.
  • Cloud Hosting & AI Inference Providers: Authenticated database hosting, cloud storage, and GPU model inference providers bound by confidentiality and security obligations.
  • Legal & Safety Obligations: When required by law, subpoena, or to protect the rights, safety, or property of Photo Make, our users, or the public (including mandatory reporting of severe safety violations).

6. Data Retention and Security

We employ industry-standard encryption in transit (TLS/HTTPS) and at rest, strict access controls, and row-level security. We retain account data and saved gallery images for as long as your account remains active. You may delete individual images directly from your gallery or request complete account and data deletion at any time by contacting [email protected].
